By creating an account, accessing or using PhenoHunting, you declare that you have read, understood and agree to be fully bound by these Terms of Service. If you do not agree with any part of this contract, you must immediately cease using the Platform.
1. Nature of Software & Object of Contract
PhenoHunting is a software tool focused exclusively on taxonomic cataloging, phenotypic data management, botanical research and scientific education. The Platform functions as a digital journal and informational analysis engine for enthusiasts, botanists and legal cultivators to document morphological characteristics, terpene profiles and plant development data.
THIS PLATFORM DOES NOT PERFORM, FACILITATE, INTERMEDIATE OR ENDORSE THE COMMERCE, PURCHASE, SALE, DISTRIBUTION, DISPENSING OR TRAFFICKING OF CANNABIS, SEEDS, CLONES, DERIVATIVES OR ANY OTHER CONTROLLED OR RESTRICTED SUBSTANCE.
2. Eligibility & Age Restriction
Access to the Platform is strictly restricted to adults. To create an account and use PhenoHunting, you must meet one of the following age requirements:
- Be 21 (twenty-one) years of age or older; or
- Be 18 (eighteen) years of age or older and hold a valid medical cannabis authorization, license or prescription issued by the competent health or government authority in your jurisdiction of residence.
By using the Platform, you declare under penalty of law that you meet the criteria described above. We reserve the right to implement age verification mechanisms at any time. Any false age declaration will constitute a serious violation of these Terms, resulting in immediate and permanent account exclusion.
3. Compliance with Local Laws & Legal Disclaimer
The legality of cultivation, possession, use and data processing related to cannabis varies significantly between countries, states and municipalities. It is the sole and non-delegable responsibility of the User to ensure that any cultivation or cataloging activity documented on the Platform is in strict compliance with the applicable federal, state, provincial or local laws in their jurisdiction of physical residence.
PhenoHunting, its developers, directors, employees and affiliates are exempt from any civil or criminal liability arising from the use of the Platform to document activities that violate laws in force at the User's access location. The Platform is provided "as-is" and does not constitute incentive, legal advice or legal validation for the cultivation or consumption of controlled substances.
4. Medical Disclaimer
Any information made available by the Platform or generated by other users regarding phytotherapeutic effects, therapeutic properties, chemical interactions or cannabinoid profiles (for example, terms such as "relaxing", "stimulating", "sleep aid", "anxiety reducer") is intended exclusively for informational, historical and botanical research purposes.
THIS PLATFORM DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS OR TREATMENT.
The data and outputs generated by the Platform do not replace professional medical opinion, health prescriptions or consultations with qualified medical professionals. Never disregard professional medical advice or delay seeking treatment due to information viewed on PhenoHunting.
5. Unauthorized Peer-to-Peer Commerce Policy
To ensure the integrity of the Platform and compliance with app store guidelines, we establish a strict policy against unauthorized peer-to-peer transactions. It is PROHIBITED for regular users to use the Platform to:
- Offer for sale, solicit for purchase, advertise, donate, trade or intermediate the physical transfer of cannabis plants, seeds, clones, dried flowers, extracts, concentrates, oils containing THC/CBD or any other restricted substance.
- Publish commercial price lists, dispensary menus, or external payment links, EXCEPT when explicitly authorized, verified, and officially integrated by PhenoHunting in partnership with legally licensed commercial entities (such as verified Breeders or Dispensaries).
- Engage in "sourcing" — characterized by posts or comments inquiring "where to buy", "who sells", or sharing private communication identifiers (such as Telegram, Signal, WhatsApp profiles or Pix/Crypto keys) for commercial purposes.
Violation of this clause will result in immediate, definitive and without prior notice banning of the offending User's account, with no right to refund of any subscription amounts.
6. Intellectual Property & User Generated Content (UGC)
Ownership: You retain intellectual property and copyright over your original content.
License of Use: You grant PhenoHunting a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable license to host, store, reproduce, modify, adapt, display, process and distribute this content within our digital ecosystem.
AI Processing: This license expressly authorizes the processing of your images and textual data by our algorithms and artificial intelligence models for the development of taxonomic statistics and strain consensus. PhenoHunting will be the exclusive owner of all aggregated databases and machine learning models generated from this data.
Metadata: You agree that the Platform may remove or modify image metadata associated with your content (including EXIF tags and GPS coordinates) for privacy and security purposes.
7. Paraconsistent Algorithm & Community Consensus
The Platform uses the Paraconsistent Decision Method (PDM) to aggregate evaluations and mathematically calculate phenotypic consensus based on multiple expert inputs.
Paraconsistent Favorable Evidence Degree

Where μ₁ represents the degree of favorable evidence and λ₁ the degree of unfavorable evidence for a given criterion, producing a contradiction-immune result across K evaluation dimensions.
- The outputs represent a deterministic mathematical consensus of subjective human evaluations. They are not absolute scientific truths and may reflect human bias or individual perception differences, rather than being outputs of a predictive generative AI.
- The User shall not use results as the sole source of scientific, agronomic or laboratory truth.
- Any reverse engineering of PhenoHunting AI models, systematic data scraping or use of outputs to train competing models is prohibited.
8. Unilateral Account Termination & Security
We reserve the right to suspend, limit or permanently delete any User's account, remove any content posted by them or restrict their access to the Platform at any time, without prior notice or justification, if we determine, at our sole discretion, that the User has violated these Terms, the Community Guidelines or the laws of their access jurisdiction.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of the jurisdiction of incorporation of PhenoHunting. Any dispute arising from or related to this contract shall be submitted to the exclusive jurisdiction of the courts of the parent company's headquarters, to the exclusion of any other forum.
